Applying for Indefinite Leave to Remain/Settlement
EU Settlement Scheme Indefinite Leave to Remain is a separate legal route to ‘settled status’ under the EU Settlement Scheme. If you hold ‘pre-settled status’ under the EU Settlement Scheme and wish to apply for ‘settled status’, please visit the information pages on gov.uk. |
Gaining Indefinite Leave to Remain (ILR)/Settlement in the UK is possible through a variety of different routes, and how you gain it depends on the type of visas you hold/have held and over what period of time. The most common routes through which our non-EEA/Swiss University staff can gain settlement are the three year Tier 1 (Exceptional Talent)/Global Talent route, the five year “work route” or the ten year “long residence” route. Therefore, our guidance only covers these three routes.
You can download our guidance below. This guidance is designed for straightforward cases. If, having read the information, you are unsure as to your eligibility for ILR through the three, five or ten year routes, please seek further guidance from the Compliance Team.
Important: once you have applied for ILR, you must not leave the Common Travel Area (the UK, Ireland, Jersey, Guernsey and the Isle of Man) until you receive a decision on your ILR application. If you do, the Home Office will consider your application withdrawn, which may result in you having no right to re-enter/live in the UK.
